Art Trade Agreement
The Basics
By agreeing to trade with me, you are stating that you have the time and means available to finish the trade as agreed within the agreed upon time frame. The work you are doing is not free, as you are indeed being payed with the same level of service from me instead of monetary payment, and neither of us are obligated to put in extra effort into the work we are creating than what we agreed we would do. Any extra effort added beyond what was agreed upon is done so by your own choice and you understand that you will not be compensated for the extra time you chose to spend.
Examples:
~ We mutually agreed on flat colors, single character, but you decide you want to do more to the picture, so you shade it. While we agreed on flats, you chose to do more, and that extra time spent will be considered a gift.
~We mutually agreed on two characters, no background, but I decide I want to add a background. The addition of the background was my choice and the extra time spent is considered a gift and you have zero obligation to repay that extra time.
Turn Around Time
The turn around time for the trade must be agreed upon before we begin the trade itself. In this way, both you and I are protected in the event that the other doesn't do their part. The absolute minimum turn around for an art trade with me is 48 hours. If you cannot complete a trade in that amount of time, we can agree to a different time frame for the both of us, and we must remain in contact with each other throughout this time period with Work In Progress (WIP) updates until the due date arrives. If the due date is set further out than 48 hours, but one of us completes their part of the trade first, the other has until the agreed upon due date to finish their piece. If the second piece is not completed within the time frame specified, the first artist has every right to remove all color from the picture and do as they see fit with the image they completed, whether they recolor it as their own or sell it as a YCH for their own profit. The person for whom the first image was drawn has zero rights to the image and any use thereof will be considered theft.
If the completed trade piece is a handmade item and not artwork, the artist who created it has the right to keep, re-sell, or otherwise dispose of/use the item in a manner they deem fitting.
If neither artist completes their part within the agreed upon time frame, the trade is considered void, and neither party will have any obligation thereafter to complete the artwork. The Trade will only remain active for as long as the parties involved communicate with each other and mutually agree on extending the time frame for the benefit of both artists and not just one. If communication fails and the due date is passed, the trade agreement between both parties is no longer valid.
Handmade Items
If the product you are offering is handmade, You are under no obligation to ship out your item to me until you have received my part of the trade. When my part is complete, I will show you a thumbnail with a watermark to prove that it has been completed. Only after you have shipped the item and provided a tracking number or proof of shipping will I send you the full sized, un watermarked image for your use.
If I complete my part, and you fail to complete yours, Your image will be erased of color and re-sold as a YCH. You will also be blacklisted from ever trading, collaborating, commissioning, or participating in any raffles, auctions or events I hold. This blacklisting can only be avoided in one of two ways:
1) Complete your trade in the time frame we agreed on
2) Stay in communication with me throughout the duration of the trade and, if necessary, ask for a time extension*
*I will only allow a time extension once. If you fail to finish your part by the second time, you will be considered untrustworthy and blacklisted.
Statement
I have read and agree to the terms of the trade as written by Hashire. I fully understand my responsibilities for the duration of our trade and I agree to meet those responsibilities to the best of my ability to ensure a smooth and pleasant experience between myself and Hashire. I understand that my obligations are only what I agreed upon, no more, no less, and I understand that any extra effort on my part is a gift and will not entitle me to any further compensation.
